LAMÉE ROOFTOP BAR HOSPITALITY AGREEMENT
Not only do we have a great view, but we also serve fantastic cocktails and have a friendly team. The entire team is committed to ensuring that every single guest has a wonderful time with us.
The Lamée Rooftop has limited seating and cannot accommodate as many guests as we would like. We are often forced to turn down large reservations in particular. Failure to show up or cancel at short notice often leaves these seats empty, resulting in considerable damage.
Please note that a confirmed table reservation is legally binding and entails certain obligations for both us and you. We ask for your understanding that we only accept reservations and provide service at the Lamée Rooftop Bar on the basis of the following terms and conditions:
---
§ 1 Scope of application
1. These terms and conditions apply to all catering contracts and all advance orders for catering services provided on the premises of RTS15 GmbH.
2. They also apply to all other deliveries and services provided to the customer/guest, including those provided off-site.
3. The customer's/guest's terms and conditions, as well as any terms and conditions of the customer/guest that conflict with or deviate from our terms and conditions, shall only apply if this has been expressly agreed in writing in advance.
4. These terms and conditions also apply to all future transactions with the customer/guest, insofar as these are legal transactions of a related nature.
---
§ 2 Reservation/Acceptance of Contract
1. The contracting parties are generally the customer/guest and RTS15 GmbH. If a third party has placed an order on behalf of the customer/guest, this third party shall be jointly and severally liable to RTS15 GmbH together with the customer/guest for all obligations arising from the hospitality contract.
2. The customer/guest warrants that the data provided to us is correct and complete. They undertake to inform us immediately of any changes to the data and to reconfirm its current accuracy upon request. This applies in particular to the customer's name and postal address, email address, and telephone number of the contact person.
If allergies and intolerances to food on the part of the customer/guest only become known during the catering, no financial compensation will be paid for any food that is not consumed.
3. Additional services such as floral decorations, special prints of menu cards, etc., as well as agency services (e.g., artists, musicians) will be charged separately.
4. Certain reservations include special food and beverages. Acceptance of the reservation request may be made conditional upon an advance payment per customer/guest.
The customer/guest undertakes to keep the reserved appointment, to arrive on time, and to select and order the reserved menu and drinks. We undertake, in accordance with the catering contract, to keep the reserved table free for the agreed appointment and to serve the guest with our catering services.
5. If the customer/guest is more than 30 minutes late, they lose their right to the reserved seating.
6. In the event of late cancellation (§ 4 No. 1) or no-show, the customer/guest is liable for a flat-rate compensation payment (no-show fee, § 4 No. 2 + 3).
7. Exclusive booking:
Exclusive booking of the Lamée Rooftop Bar (e.g., for private events) is only possible on the basis of an individual offer. Please contact us directly by email.
---
§ 3 Vouchers
The following conditions apply to the redemption of vouchers issued by us:
1. A voucher can only be used to pay for food and drinks offered and consumed at the Lamée Rooftop Bar. Cash payment of the voucher amount is not possible.
2. A voucher can only be used once (up to the amount stated) for payment. It is not possible to split the voucher amount (e.g. over several visits).
3. Any remaining amounts, if the price of the food and beverages consumed does not reach the full voucher amount, cannot be paid out.
---
§ 4 Cancellation/No-Show Fee
We would like to inform our valued guests that a no-show fee may be charged if they fail to show up for a reservation without prior cancellation or change. This fee serves to cover the costs of unused tables and potential loss of revenue.
1. A catering contract concluded in accordance with § 2 may be canceled free of charge up to 120 hours (5 days) in advance for reservations of more than 20 people and up to 72 hours (3 days) in advance for reservations of up to 20 people, either in writing, by telephone, or by email.
For reservations involving increased effort, other cancellation periods may be agreed in writing.
2. Amount of the fee:
For cancellations after the deadlines specified in No. 1 or in the event of a no-show, a flat-rate compensation fee (no-show fee) of €20 per person shall be payable.
The amount of the no-show fee may vary depending on the reservation and the associated costs. Details can be found in the reservation conditions or are available on request.
3. Payment terms:
In this case, we are entitled to charge the respective credit card with the aforementioned flat-rate compensation, unless an advance payment of the corresponding amount has already been made (§ 2 No. 3).
4. The provisions in No. 2 shall also apply if customers/guests arrive but do not use the reserved seats. This applies in particular if more people arrive than announced and no further seats can be provided.
5. If the catering contract includes ancillary or agency services (see § 2 No. 3), the contractual partner must reimburse us in full for the cancellation fees charged to us.
6. Please note that due to the increased material and planning costs, purchased tickets cannot be returned or refunded in accordance with the applicable regulations. The tickets are only valid on the day of the event.
